Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Kalori ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Sunbranch AS ("we", "us", or "our") governing your use of the App.

2. Description of Service

Kalori is a calorie and nutrition tracking application that helps users:

• Log daily meals and food intake
• Track calories, macronutrients (protein, carbs, fats), and other nutritional data
• Set and monitor health and fitness goals
• Analyze eating patterns and nutritional habits
• Scan food items using photos for automatic recognition (optional feature)

3. User Accounts

To use the App, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

You must be at least 13 years old to create an account.

If you are between 13 and 17 years old, you must have permission from a parent or legal guardian to use the App. Your parent or guardian must review and agree to these Terms on your behalf. By allowing you to use the App, they agree to be responsible for your activity and compliance with these Terms.

4. Subscription and Payments

Kalori offers premium features through subscription plans. By subscribing:

• You authorize us to charge your payment method for the subscription fee
• Subscriptions automatically renew unless cancelled before the renewal date
• Prices may change with reasonable notice
• Refunds are handled according to the policies of Apple App Store or Google Play Store

Free trial periods, if offered, will convert to paid subscriptions unless cancelled before the trial ends.

5. User Content

You retain ownership of content you create in the App, including:

• Custom food entries you create
• Meal photos you upload
• Personal health data you input

By uploading content, you grant us a worldwide, royalty-free license to use, process, store, and display this content for the following purposes:

• Providing and improving the App's services to you
• Analyzing food photos to identify nutritional content
• Creating anonymized, aggregated data for service improvements

This license continues until you delete your content or account. After deletion, we will remove your personal content within 30 days, except for anonymized data that cannot be traced back to you.

6. Prohibited Uses

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Upload malicious content or code
• Impersonate others or provide false information
• Use the App to harass, abuse, or harm others
• Reverse engineer or attempt to extract source code
• Use automated systems to access the App without permission
• Upload images of other people without their consent

7. Health & Accuracy Disclaimer

The App is intended for general informational and educational purposes only. You should not rely solely on the App's data for dietary decisions, especially if you have specific health conditions or dietary requirements.

All calorie counts, nutritional values, and macro calculations provided by the App are estimates only. Actual nutritional content may vary based on:

• Variations in food preparation and portion sizes
• Differences between database entries and actual products
• Limitations of AI-based food recognition
• Regional variations in food products

Always consult with qualified healthcare professionals before:

• Starting any diet or nutrition program
• Making decisions about your health based on App data
• Using the App if you have eating disorders, diabetes, or related conditions

We are not responsible for any health decisions you make based on information from the App, nor for any inaccuracies in nutritional data.

8. Intellectual Property

The App, including its design, features, content, and underlying technology, is owned by Sunbranch AS and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Use our trademarks without permission
• Create derivative works based on the App

9. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "as is" without warranties of any kind
• We do not guarantee the accuracy of nutritional data from any source
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the greater of: (a) the amount you paid for the App in the past 12 months, or (b) 100 NOK

Nothing in these Terms affects your statutory rights as a consumer under applicable law.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the App's settings.

Upon termination, your right to use the App ceases immediately. We will delete your personal data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination will remain in effect.

11. Governing Law

These Terms are governed by the laws of Norway. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Norway.

If you are a consumer in the European Union, you may also be entitled to bring claims in your country of residence. Nothing in these Terms limits your rights under mandatory consumer protection laws.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or by email at least 30 days before they take effect. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you may delete your account before they take effect.
